Terms of service

By placing an order with Flowers by Booths you are agreeing to the following terms and conditions.

1.  ORDERS AND CANCELLATIONS

1.1 All orders are subject to acceptance by Flowers by Booths, and any of its personnel, reserve the right, at our discretion, to reject any order without giving reasons. In the event of rejection, we will refund any payments in full, via the payment method used to place the order.

1.2 If you wish to cancel or change your order, please email us at booths@lovedelivered.co.uk. Please note that any changes to your order must be made by 9am 2 days before the intended delivery date. We will always do our best to make last minute changes for you, but we cannot guarantee that any changes will be processed if we are informed after this time.

2. PRICES

2.1 All prices include delivery charges unless otherwise stated.

3. PAYMENTS

3.1 We accept American Express, Visa and MasterCard credit and debit cards as well as Paypal, Apple Pay, and Google Pay. In order to offer the best security, all our payments are processed securely by Shopify or, if selected as a payment option, Paypal.

3.2 For all ongoing subscriptions, your credit or debit card will be billed at checkout for your first delivery only. For ongoing deliveries, you will be billed on a recurring basis every month in which delivery is scheduled. The amount your card will be billed in any given month will be the value of your order(s) for the given month.

3.3 If you create an account and enter your payment details, your card will be stored securely by Shopify so that you can check out on future visits without re-entering your card details.

3.4 We never store or have access to your credit or debit card details.

4. DELIVERY

4.1 You will receive your delivery from a third-party courier service usually DPD.

4.2 Timed deliveries are not available.

4.3 Please ensure all delivery details are correct, we will not be able to refund or replace the order if incorrect information has been provided to us. This must be done by 9am two days before the intended delivery date.

4.4 We cannot guarantee that delivery instructions will be followed.

4.5 Flowers by Booths cannot be held responsible if a delivery arrives late due to any circumstances impacting the availability of the courier services used or anything else outside of Flowers by Booths’s control.

4.6 Flowers by Booths only delivers within the United Kingdom.

4.7 In the event of a non-delivery (flowers have not arrived 2 days after their intended delivery date), please contact us at booths@lovedelivered.co.uk. It is the customer’s responsibility to contact us within 7 days of the schedules delivery date in order to claim a refund. Failure to do will result in the lapse of any right to a refund.

5. RETURNS AND REFUNDS

5.1 If you ever have a problem, please get in touch via our email and we will get back to you as soon as we can.

5.2 It is important that the flowers are cared for correctly to ensure they stay at their best for longer. They should be placed away from heat sources or draughts, and water should be changed or topped up every two days. We include instructions on how to look after your flowers, and use your flower food with every order. If flowers have not been cared for properly, we will not refund or resend them.

5.3 Flowers are occasionally sent out in bud form, which can be confused with poor quality. The flowers will quickly open when placed in room temperature and kept in the proper conditions.

5.4 We are unable to accept returns due to the perishable nature of the product.

5.5 While we do our best to ensure that the flowers arrive in perfect condition, on a small number of occasions (for reasons beyond our control) they may arrive damaged. If the recipient receives damaged flowers, please notify us and email a photograph of the damage within 24 hours of receipt.

5.6 All floral products are subject to availability. We reserve the right, at our absolute discretion, to substitute any product with an alternate product of a similar style and equivalent (or greater) value and quality.

6. CIRCUMSTANCES BEYOND OUR CONTROL

6.1 It is possible that errors may occur within our system, due to unseen circumstances. While we take every precaution to ensure our systems run without fault, if problems do occur, we will endeavour to fulfil all orders on the requested dates. However, if this is not possible, we shall contact the customer to either refund or rearrange the order.

6.2 Force Majeure: Neither Flowers by Booths, nor any courier service that we use, shall be liable for any failure to perform any obligations if the delay results from any of the following but not limited to: acts of God, outbreaks of hostilities, riot, civil disturbances, acts of terrorism, the act of any government or authority, fire, explosion, flood, adverse weather, power failure, failure of telecommunication lines; failure or breakdown of plant, machinery or vehicles; default of suppliers, sub-contractors or delivery partners, theft, malicious damage, strike, lock-out or industrial action of any kind and any cause or circumstance beyond our reasonable control.

6.3 During adverse weather conditions (including, but not limited to heavy snow, ice, high winds, flooding) our delivery services may not be able to deliver. This is outside of our control; therefore, we cannot accept responsibility for the late delivery of the order or offer refunds of affected orders.

7. SPECIAL OFFERS AND PROMOTIONAL CODES

7.1 At our discretion, from time to time, we may offer promotional codes or products at discounted prices. These offers are valid from the time that we introduce them to the end date of the offer, and they cannot be used for purchases before the offer induction date or after the offer date end.

7.2 In the event that a customer has made a purchase and the price of the product falls or is discounted due to a special offer, the price of the product at the time of the purchase shall prevail. We are unable to offer special discounts for purchases that have already been made.

7.3 Unless explicitly expressed otherwise, free or discounted introductory offers are only available to new users and are only available once to any one household.

7.4 A special offer or promotional code cannot be used in conjunction with any other special offer or promotional code.

7.5 Only one promotional code may be used per order.

7.6 We reserve the right to offer personalised special offers and promotions which will only be redeemable by the customer in receipt of the special offer.

7.7 Unless stated otherwise, promotional codes cannot be redeemed against or applied to orders placed during key peak periods where supply is limited. These include but are not limited to, 7 days up to and including Valentine’s Day and Mother’s Day.

8. CUSTOMER AND RECIPIENT PERSONAL INFORMATION

8.1 We value your privacy and will never lease, rent or sell your private information. For more information, please see our privacy policy.

8.2 To ensure that we can communicate effectively with both customer and recipient, it is very important that you provide accurate personal information.

9. ABUSIVE BEHAVIOUR

9.1 We will not tolerate abusive behaviour of any kind. If anyone is abusive to any of our staff, we will terminate all contact and will not resume unless the dialogue is in a non-abusive fashion. We reserve the right to not do business with returning customers who were abusive in the past.

10. GENERAL

10.1 You may not edit, modify or distribute any material or content from our website.

10.2 We reserve the right to supplement and amend the Terms and Conditions. We will post the changes on the Love delivered website and it is your responsibility as a customer to review the Terms and Conditions on each occasion you access the Love delivered website. Changes shall be effective five hours after the posting of any such changes and all subsequent dealings between you and us shall be on the new Terms and Conditions.

10.3 We do not guarantee that our website or services shall be uninterrupted or error-free and we will not be responsible for any losses arising from such errors or interruptions. We reserve the right to suspend, restrict or terminate access to the Flowers by Booths website and/or the services for any reason at any time for repair, maintenance, improvement or other technical reason, and to make changes to them.

10.4 These terms and conditions shall be deemed to include all other notices, policies, disclaimers and other terms contained in the Flowers by Booths site, provided that in the event of a conflict between any such other notices, policies, disclaimers and other terms, these Terms and Conditions shall prevail. If any of these Terms and Conditions is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

10.5 A person who is not a party to the agreement between you and us has no rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any of the Terms and Conditions but this does not affect any right or remedy which exists apart from that Act.

10.6 In respect of fraudulent misrepresentation, the agreement (including and documents and instructions referred to herein) supersedes all prior representations, arrangements, understandings, and agreements between you and us (whether written or oral) and sets forth the entire agreement and understanding between you and us relating to the subject matter hereof.

10.7 Your purchase will be deemed to have occurred in the UK if the delivery was to an address in the UK. In the event of a delivery to an address in the UK, these Terms and Conditions shall be governed by and construed in accordance with English and Welsh Law and the parties agree to submit to the exclusive jurisdiction of the English and Welsh courts.
